Privacy Policy
The LED Guru cares deeply about your privacy. We therefore process only the data we need to provide and improve our services, and we handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes. This privacy policy applies to the use of the website and the services provided by the LED Guru through it. The effective date of these terms is April 30, 2018; upon publication of a new version, all previous versions cease to be valid. This privacy policy describes what information we collect about you, how this information is used, and with whom and under what conditions this information may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you provide to us. If you have any questions about our Privacy Policy, please contact our privacy officer; you will find the contact information at the end of our Privacy Policy.
Below, you can read about how we process your data, where we store it (or have it stored), what security measures we use, and who has access to the data.
SOFTWARE
Our website was developed using WordPress software, and we have chosen Transip for our web hosting. Personal data that you provide to us for the purpose of our services will be shared with Transip. Transip has access to your data to provide us with (technical) support; they will never use your data for any other purpose. Under the agreement we have entered into with Transip, they are required to implement appropriate security measures. These security measures include the use of SSL encryption and a strong password policy. Regular backups are performed to prevent data loss.
Our online store was developed using WooCommerce software. WooCommerce is a free plugin for WordPress.
WEB HOSTING
We use Transip for web hosting and email services. Transip processes personal data on our behalf and does not use your data for its own purposes. However, Transip may collect metadata regarding the use of the services. This metadata does not constitute personal data. Transip has implemented appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. Transip is bound by a confidentiality agreement.
E-MAIL AND MAILING LISTS
We send our email newsletters using MailChimp. MailChimp will never use your name or email address for its own purposes. At the bottom of every email sent automatically through our website, you’ll see an ‘unsubscribe’ link. If you click it, you will no longer receive our newsletter. MailChimp stores your personal data securely. MailChimp uses cookies and other internet technologies to track whether emails are opened and read. MailChimp reserves the right to use your data to further improve its services and, in that context, to share information with third parties.
We use Transip’s services for our regular business email correspondence. Transip has implemented appropriate technical and organizational measures to prevent, to the greatest extent possible, the misuse, loss, and corruption of your and our data. Transip does not have access to our inbox, and we treat all our email correspondence as confidential.
PAYMENT PROCESSORS
We use the Mollie platform to process (some of) the payments in our online store. Mollie processes your name, address, and city of residence, as well as your payment information, such as your bank account or credit card number. Mollie has implemented appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve its services and, in that context, to share (anonymized) data with third parties. All of the safeguards mentioned above regarding the protection of your personal data also apply to those parts of Mollie’s services for which they engage third parties. Mollie does not retain your data for longer than is permitted by law.
PURPOSE OF DATA PROCESSING
We use your data exclusively for the purpose of providing our services. This means that the purpose of the processing is always directly related to the request you submit. We do not use your data for (targeted) marketing. If you share data with us and we use that data to contact you at a later time—other than at your request—we will ask for your explicit consent to do so. Your data will not be shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound by confidentiality obligations under the agreement between them and us, or by an oath or legal obligation.
Data collected automatically by our website is processed for the purpose of further improving our services. This data (such as your IP address, web browser, and operating system) does not constitute personal data.
In certain cases, LED Goeroe may be required by law to share your data in connection with a government tax or criminal investigation. In such a case, we are compelled to share your data, but we will oppose this to the extent permitted by law.
We retain your data for as long as you are our client. This means that we will retain your customer profile until you indicate that you no longer wish to use our services. If you notify us of this, we will also consider it a request to be forgotten. Due to applicable administrative obligations, we are required to retain invoices containing your (personal) data; we will therefore retain this data for as long as the applicable retention period remains in effect. However, employees will no longer have access to your client profile or to documents we have prepared in connection with your engagement.
YOUR RIGHTS
Under applicable Dutch and European law, as a data subject, you have certain rights regarding the personal data processed by us or on our behalf. Below, we explain what these rights are and how you can exercise them.
In principle, to prevent misuse, we send copies and extracts of your data only to the email address we already have on file for you. If you wish to receive the data at a different email address or, for example, by mail, we will ask you to verify your identity. We maintain a record of processed requests; in the case of a request to be forgotten, we store anonymized data. You will receive all copies and extracts of data in the machine-readable format that we use within our systems.
You have the right at any time to file a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data inappropriately.
You always have the right to access the data that we process (or have processed) and that relates to you personally or can be traced back to you. You may submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all the data to the email address we have on file, along with a list of the processors who have access to this data, specifying the category under which we have stored this data.
You always have the right to have the data we process (or have processed) that relates to you or can be traced back to you corrected. You may submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the data has been corrected to the email address we have on file.
You always have the right to restrict the processing of personal data that relates to you or can be traced back to you, whether we process it ourselves or have it processed by others. You may submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we have on file stating that the data will no longer be processed until you lift the restriction.
You always have the right to have the data that we process (or have processed) and that relates to you personally or can be traced back to you transferred to another party. You may submit a request to that effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you, to the email address we have on file, copies of all data about you that we have processed or that has been processed on our behalf by other processors or third parties. In all likelihood, we will no longer be able to continue providing our services in such a case, as the secure linking of data files can no longer be guaranteed.
In applicable cases, you have the right to object to the processing of your personal data by or on behalf of LED Goeroe. If you object, we will immediately cease processing your data pending the resolution of your objection. If your objection is valid, we will provide you with copies of the data we process (or have processed) and will then permanently cease processing it.
You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in a way that would trigger this right. If you believe this is the case, please contact our privacy officer.
COOKIES
Cookies from the U.S. company Google are placed via our website as part of the “Analytics” service. We use this service to track and receive reports on how visitors use the website. This data processor may be required by applicable laws and regulations to provide access to this data. We collect information about your browsing behavior and share this data with Google. Google may interpret this information in conjunction with other datasets and thereby track your online activity. Google uses this information to provide, among other things, targeted advertisements (AdWords) and other Google services and products.
If third-party software solutions use cookies, this is stated in this privacy statement.
CHANGES TO THE PRIVACY POLICY
We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy affects how we process data we have already collected about you, we will notify you by email.
